Update on Laptop file

So, I have a new one for you guys to chew on.

Before I start though, I would like to post the results of the hearing over the laptop. After the judge heard all the arguments and saw all the related documents, he told "the other guy" that he was a fool to insist on taking it to court, and said that while he can't 'speak for what other judges would say, he said in no uncertain terms that he himself is a judge, and that if this twit brought this case to court, it would be looked upon as a frivolous action.

After everyone had presented their cases, my boys offering to take a very generous payment arrangement based upon his wholesale price, and on account of him stating right out loud that "although the guys were morally correct, he was not obliged to cover the loss" - this judge asked everyone to leave the room for about 5 minutes.

Funny enough, the 'other guy' was the last one to understand the order/request. He sat there in his chair, and the hearing judge had to tell him that the only reason he had suggested we all leave was that he had the hope that he would come to his senses, warning him that it was important to settle, because he will lose, and be not only out the money so far, but all of that and lawyers' fees and court costs besides.

I know this guy. I worked for him. He has an interesting 'twist' to his personality and this is just one more offshoot. One day I could tell you about the mutiny me and the boys staged on account of him insisting that a particular woman come to clean. Nobody objected to having a clean place, but she screeched at people in front of customers, and had a habit of having her arguments with the phone and hydro companies right in front of those customers too, while her kids played on the computers that held the company data. If I got there when she was already there, I had to employ "tactics" to get whichever one of her kids was using my office computer away from it.

She raked the guys in the back over the coals if they accidentally tripped over her vacuum cord while they were repairing it, and raked the owner over the coals for not informing her in advance that she would have to encounter such "disrespect" for these kids that she obviously has no concern for herself.

(I hate that word. One "earns" respect. It doesn't come with the job!)

I blew up that day, along with the two guys who also worked for him. We all just dropped what we were doing, and left. When she had gone, we returned and told him enmasse (all three of us) that if he insisted on keeping her, we wanted it to happen when we weren't around.

We also "demanded" respect, but we had to point out to him who amongst us, including his partner, had the "right" to "feel" what we did, and we curtailed his future use of that service-provider - if he insisted upon keeping this psycho, at least we were assured that she would not be on the premises when we were. But then not long after that, I quit working there.

I coudn't stifle my thoughts the last day I was there at the same time that she was, and neither could the boys in the back. Think about it. He had the hots for this gal and his biggest mission in life to to convince his girlfriend that it wasn't true, and the only reason she believes him to this day is the fact that she wasn't there when it happened.

He has now altered the court date by naming his insurance company as a third party. I don't blame him for doing so, but I told him in the first place that it was HIS problem - give the boys who bought a brand new laptop from you a replacement, order a new one for them, and take his insurance company to court. These young fellows (in their early 20s) were robbed of 40-grand only two months after they incorporated. They then had their compressor stolen. And then they had their only computer stolen. All inside their first year. I have my doubts, as their been-around-the-block-bookkeeper, that they will ever be able to catch up.

I haven't told them in so many words just yet, but I believe that they will have to declare bankruptcy in the not-too-distant future. Think about it - you have to make a profit of at least the amount of your bad debts to even break even. How on earth can these guys ever catch up to the 40k, the computer, and the compressor, to the point where they can pay what they "owe" the various and sundry gov't entities?

Anyone want to tackle this?

That guy is one piece of work. I am glad to see the hearing went pretty much along the lines I suggested. Too bad about the kids,. I wonder if they might have another civil suit against clown boy once it is all over?
